PENN HILL GROUP’S WRAP UP – JULY 13, 2026

ADMINISTRATION

The Administration released the Fall 2026 Unified Regulatory Agenda, outlining the planned regulatory actions for the coming months for the U.S. Department of Education (ED) and other Federal agencies.

ED approved a set of flexibilities for the State of Arkansas related to certain Elementary and Secondary Education Act (ESEA) funding and the use of assessments under Title I-A. ED also approved the State of Arkansas for Ed-Flex authority.

ED’s Office for Civil Rights launched an initiative aimed at reducing sexual misconduct in K-12 schools.

CONGRESS

The House Education and Workforce Committee announced the introduction of ten bills as part of a legislative package aimed at codifying several of the Administration’s Interagency Agreements that transfer functions from ED to other Federal agencies.

COURTS

House Education and Workforce Committee Chairman Tim Walberg (R-MI) and Senator James Lankford (R-OK) led 43 Members of Congress in filing an amicus brief in an upcoming U.S. Supreme Court case on the constitutional rights of faith-based schools participating in school choice programs.
