CONGRESS 

U.S. House of Representatives Committee on Education and the Workforce Chairwoman Virginia Foxx (R-NC) sent a letter to the U.S. Department of Education (ED) on foreign gift reporting for institutions of higher education. 

House Republicans sent a letter to ED requesting documents to conduct oversight on ED’s administration of Elementary and Secondary School Emergency Relief (ESSER) funds. 

ADMINISTRATION 

ED released an unofficial version of proposed regulations pertaining to Title IX and student eligibility for athletic teams and released a fact sheet in conjunction with this regulation. 

U.S. Secretary of Education Miguel Cardona issued a statement on Transgender Day of Visibility regarding transgender students. 

U.S. Department of Health and Human Services (HHS) interim final rule mandating vaccines for Head Start staff was struck down by a U.S. District Court in the Northern District of Texas. 

The U.S. Department of Agriculture extended the public comment period on its proposed rule “Child Nutrition Programs: Revisions to Meal Patterns Consistent With the 2020 Dietary  Guidelines for Americans,” from April 10, 2023 to May 10, 2023. 

2U and Get Educated filed a Federal complaint suing ED for violating the Administrative Procedure Act and Higher Education Act in the recent issuance of Federal guidance on third-party servicers. 

SUPREME COURT 

Three institutions involved in the Sweet v. Cardona borrower defense to repayment class action suit asked the Supreme Court of the United States (SCOTUS) to hear the case after a Federal appeals court upheld a U.S. District Court decision to allow a settlement agreement to move forward.
